The national government of France is divided into an executive branch, a legislative branch and a judiciary branch. The President of France has some direct executive power but most of the formal power resides in his appointee the Prime Minister of France, the choice of which in practice has to be approved by the French National Assembly, the lower house of Parliament (see below for a discussion of the division of power between the President and Prime Minister). Parliament passes statutes and votes the budget; it also controls the action of the executive through questioning and enquiry commissions. The constitutionality of the statutes is checked by the Constitutional Council. Finally, the independent judiciary is divided into the judicial branch (dealing with civil and criminal law) and the administrative branch (dealing with recourses against executive decisions), each with their own independent supreme court. In addition, the French government comprises various bodies checking against possible abuses of power and independant agencies. Settled mainly by the Gauls and related Celtic peoples (apart from a shrinking area of Basque population in the south-west and Ligurian population on the southern coast), the area of modern France comprised the bulk of the region of Gaul (Latin Gallia) under Roman rule from the 1st century BC to the 5th century AD. Senators are chosen by an electoral college of about 145,000 local elected officials for 6-year terms, and one half of the Senate is renewed every 3 years. Before the law of 30 July 2004, senators were elected for 9 years, renewed by thirds every 3 years. There are currently 321 senators, but there will be 346 in 2010; 304 represent the metropolitan and overseas départements, five the other dependencies and 12 the French established abroad. Dirigisme came to be highly contested in the 1980s, with complaints of bureaucracy and lack of reactivity to new challenges. As a result the government largely retreated from economic intervention; Dirigisme has now essentially receded. Despite significant reform and privatization over the past 15 years, the government continues to control a large share of economic activity: Government spending, at 53% of GDP in 2000, is the highest in the G-7. Labour conditions and wages are highly regulated. The government continues to own shares in corporations in a range of sectors, including banking, energy production and distribution, automobiles, transportation, and telecommunications. In its Constitution, France declares itself to be an indivisible, laïque (roughly, "secular") democratic and social republic. France's constitution enacts a separation of powers as well as the respect for a number of constitutional rights. The May 1958 seizure of power in Algiers by French army units and French settlers opposed to concessions in the face of Arab nationalist insurrection led to the fall of the French government and a presidential invitation to de Gaulle to form an emergency government to forestall the threat of civil war. Swiftly replacing the existing constitution with one strengthening the powers of the presidency, he became the elected president in December of that year, inaugurating France's Fifth Republic. France is a unitary state. However, the various legal subdivisions, the régions, départements and communes, have various attributions, and the national government is prohibited from intruding into their legal normal operations. Louis XVI's reign (1774-1792) saw a temporary revival of French fortunes through intervention (1778-1783) in support of Britain's rebel American colonies. But the over-ambitious projects and military campaigns the past century had produced chronic financial problems. Deteriorating economic conditions, popular resentment against the complicated system of privileges granted the nobility and clerics, and a lack of alternate avenues for change were among the principal causes of the French Revolution. This led to the formation of the First Republic on September 21, 1792. Due to its numerous overseas departments and territories scattered on all oceans of the planet, France possesses the second-largest exclusive economic zone (EEZ) in the world, covering 11,035,000 km² (4,260,000 sq. miles), just behind the EEZ of the United States (11,351,000 km² / 4,383,000 sq. miles), but ahead of the EEZ of Australia (8,232,000 km² / 3,178,000 sq. miles). According to a different calculation cited by the Pew Research Center, the EEZ of France would be 10,084,201 km² (3,893,532 sq. miles), behind the United States (12,174,629 km² / 4,700,651 sq. miles), but ahead of Australia (8,980,568 km² / 3,467,416 sq. miles) and Russia (7,566,673 km² / 2,921,508 sq. miles). France has a system of civil law, but jurisprudence plays an important role similar to that of case law. France uses a civil law system; that is, law arises primarly from written statutes; judges are supposed not to make law, but to merely interpret it (though the amount of judge interpretation in certain areas makes it equivalent to case law). Many fundamental principles of French Law were laid in the Napoleonic Codes. Basic principles of the rule of law were laid in the Napoleonic Code: laws can only address the future and not the past (ex post facto laws are prohibited); to be applicable, laws must have been officially published (see Journal Officiel). The extinction of the main Capetian line (1328) brought to the throne the related house of Valois, but as Philippe IV's grandson, Edward III of England claimed the French crown for himself, inaugurating the succession of conflicts known collectively as the Hundred Years' War. The following century was to see devastating warfare, peasant revolts in both England (Wat Tyler's revolt of 1381) and France (the Jacquerie of 1358) and the growth of nationhood in both countries. Statute legislation may be proposed by the government (i.e. the council of ministers), or by members of parliament. In the first case, it is a projet de loi, in the latter case, a proposition de loi. All projets de loi must undergo compulsory advisory review by the Conseil d'État before being submitted to parliament. Propositions de loi cannot increase the financial load of the state without providing for funding.
