The gouvernement, or cabinet, is headed by the Prime Minister of France. It has at its disposal the civil service the government agencies and the armed forces. (The term "cabinet" itself is rarely used in this sense, even in translation, as it is used in French to mean a minister's private office. In French, the word gouvernement can refer to government, but generally refers to the cabinet.) The National Assembly may cause the resignation of the executive cabinet by voting a motion of censure. For this reason, the prime minister and his cabinet are necessarily from the dominant party or coalition in the assembly. In the case of a president and assembly from opposing parties, this leads to the situation known as cohabitation. While motions of censure are periodically proposed by the opposition following government actions that it deems highly inappropriate, they are purely rhetorical; party discipline ensures that, throughout a parliamentary term, the government is never overthrown by the Assembly. A popular referendum approved the constitution of the French Fifth Republic in 1958, greatly strengthening the authority of the presidency and the executive in relation to Parliament. The French constitution establishes a semi-presidential system, where the President of France has a strong influence, but where, ultimately, the deciding factor is the majority of the French National Assembly. France is a democracy organised as a unitary semi-presidential republic. It is a developed nation whose modern economy is the fifth-largest in the world in 2003. Its main values are expressed in the Declaration of the Rights of Man and of the Citizen. The constitution does not contain a bill of rights in itself, but its preamble mentions that France should follow the principles of the Declaration of the Rights of Man and of the Citizen, as well as those of the preamble to the constitution of the Fourth Republic. This has been judged to imply that the principles laid in those texts had constitutional value, and that legislation infringing on those principles should be found unconstitutional. The national government of France is divided into an executive branch, a legislative branch and a judiciary branch. The President of France has some direct executive power but most of the formal power resides in his appointee the Prime Minister of France, the choice of which in practice has to be approved by the French National Assembly, the lower house of Parliament (see below for a discussion of the division of power between the President and Prime Minister). Parliament passes statutes and votes the budget; it also controls the action of the executive through questioning and enquiry commissions. The constitutionality of the statutes is checked by the Constitutional Council. Finally, the independent judiciary is divided into the judicial branch (dealing with civil and criminal law) and the administrative branch (dealing with recourses against executive decisions), each with their own independent supreme court. In addition, the French government comprises various bodies checking against possible abuses of power and independant agencies. Current President Jacques Chirac assumed office May 17, 1995, after a campaign focused on the need to combat France's stubbornly high unemployment rate. The center of domestic attention soon shifted, however, to the economic reform and belt-tightening measures required for France to meet the criteria for Economic and Monetary Union (EMU) laid out by the Maastricht Treaty. In late 1995, France experienced its worst labor unrest in at least a decade, as employees protested government cutbacks. Settled mainly by the Gauls and related Celtic peoples (apart from a shrinking area of Basque population in the south-west and Ligurian population on the southern coast), the area of modern France comprised the bulk of the region of Gaul (Latin Gallia) under Roman rule from the 1st century BC to the 5th century AD. France is a founding member of the European Union, and its largest member state with respect to land area. France is also a founding member of NATO and the UN, and a permanent member of the UN Security Council. It is one of only seven acknowledged nuclear powers in existence. The May 1958 seizure of power in Algiers by French army units and French settlers opposed to concessions in the face of Arab nationalist insurrection led to the fall of the French government and a presidential invitation to de Gaulle to form an emergency government to forestall the threat of civil war. Swiftly replacing the existing constitution with one strengthening the powers of the presidency, he became the elected president in December of that year, inaugurating France's Fifth Republic. Government economic policy aims to promote investment and domestic growth in a stable fiscal and monetary environment. Creating jobs and reducing the high unemployment rate has been a top priority. Statute legislation may be proposed by the government (i.e. the council of ministers), or by members of parliament. In the first case, it is a projet de loi, in the latter case, a proposition de loi. All projets de loi must undergo compulsory advisory review by the Conseil d'État before being submitted to parliament. Propositions de loi cannot increase the financial load of the state without providing for funding. After the Allied landings in North Africa (Operation Torch) the German Army occupied southern France as well (Case Anton), leading to the scuttling of the French Fleet at Toulon. After four years of occupation and strife, Allied forces, including Free French Forces, liberated France in 1944.France emerged from World War II to face a series of new problems. After a short period of provisional government initially led by General Charles de Gaulle, a new constitution (October 13, 1946) established the Fourth Republic under a parliamentary form of government controlled by a series of coalitions. The mixed nature of the coalitions and a consequent lack of agreement on measures for dealing with colonial wars in Indochina and Algeria caused successive cabinet crises and changes of government. The war in Indochina ended with French withdrawal in 1954. The reign (1715-1774) of Louis XV saw an initial return to peace and prosperity under the regency (1715-1723) of Philippe II, duke of Orléans, whose policies were largely continued (1726-1743) by Cardinal Fleury, prime minister in all but name, renewed war with the Empire (1733-1735 and 1740-1748) being fought largely in the East. But alliance with the traditional Habsburg enemy (the "Diplomatic Revolution" of 1756) against the rising power of Britain and Prussia led to costly failure in the Seven Years' War (1756-1763). Citizens from all parts of France, including overseas possessions, vote in national elections (presidential, legislative) and are represented to the Senate. Contrary to other countries such as the United States, there is not a two-tiered system whereby some parts of the territory have the right to vote in national elections, and some do not.
